WASHINGTON - A Duke University lacrosse player charged with rape in North Carolina will face an assault trial in D.C.

Collin Finnerty, 20, appeared before D.C. Superior Court Judge John Bayly Tuesday morning for a status hearing in connection with an assault in Georgetown.

Finnerty was arrested in November for allegedly punching a man outside the Daily Grill.

Prosecutors offered Finnerty a deal that stated if he completed 25 hours of community service and stayed out of trouble for six months, his case would be dismissed.

However those terms were breached as a result of Finnerty's arrest in the Duke case.

Finnerty remained silent during his hearing, only responding "yes, your honor," when Judge Bayly asked him if he understood the conditions of his release.

He remains free pending a July 10 trial date.

Finnerty faces up to six months in jail and a fine of up to $1,000 if convicted of simple assault in the D.C. case.

Finnerty is one of two students charged with rape in Durham, North Carolina, in connection with an off campus party held by lacrosse team members last month.
