Fair Debt Collection

A listener received a letter stating that she had an account that was never paid and the sender offered her a new credit card to use in paying off the debt. An investigation revealed that the letter was not from a credit card company, but from a debt collection agency and it was attempting to get Karen to acknowledge a debt. According to Karen, she does not have any unpaid accounts. Even so, she should respond to this type of letter.

Under the Fair Debt Collection Practices Act, she should respond to this type of letter or the company can assume the debt belongs to her. While this doesn't sound fair, it's the law.

Don't ignore a letter of this type. Write and state that the debt does not belong to you. Also, you should ask for any proof they might have that the debt is yours.
